General conditions of sale for the general public

PREAMBLE

  1. These conditions apply to all reservations made with the company L’HOTEL DE CARANTEC SARL operating the hotel restaurant L’HÔTEL DE CARANTEC RESTAURANT NICOLAS CARRO in CARANTEC. They cannot be opposed for any reservations made through a reseller of the company L’HOTEL DE CARANTEC SARL (ex Booking.com, Expedia, Wonderbox, Groupon, etc.) except for points: III, G – IV, H –
    VII – VIII- IX – X – XI & XII valid for all guests staying in the establishment.
  2. For any reservation made through a reseller of the company L’HOTEL DE CARANTEC SARL, please refer to the reseller’s General Conditions of Sale.
  3. The customer declares to have full legal capacity allowing him to commit to these general conditions.
  4. The customer’s agreement regarding the general conditions of sale and the conditions of sale of the reserved rate occurs during the reservation; no reservation is possible without this agreement.
  5. The customer has the option of saving and editing these general conditions using the standard functionalities of his browser or computer.

I. RESERVATION

  1. The prices offered by quote remain firm until the date of the option.
  2. The reservation only becomes final upon receipt of the deposit paid for the service. The amount of the deposit varies depending on the service offered.
  3. Reservations cannot be taken into account without payment of the deposit or communication of the unique code of a gift voucher or gift voucher.
  4. Reservations cannot be taken into account without communication of a bank card number as well as its validity date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram.
  5. Reservations cannot be taken into account without a valid email address. The latter is used to communicate the details of the reservation and the General Conditions of Sale relating to the reservation.

II. PRICES

  1. Prices are indicated in Euros. VAT is always included. The prices indicated only include the services strictly mentioned in the reservation. To the price mentioned in the reservation will be added, when invoicing, the additional services provided by the hotelier during the stay and, where applicable, the tourist tax.
  2. The applicable prices are those in effect on the day of reservation. Hoteliers, independent professionals, are free to vary their prices at any time. Also, the price displayed during a visit to our website is only valid for orders taken during the duration of its display. Only the price indicated in the reservation confirmation is contractual.
  3. “Best rate guaranteed” mention – After reserving a room on hotel-carantec.fr, and within a maximum period of 24 hours, the price difference can be refunded if the rate noted with another e-distributor (e.g. Booking, Hotels.com, Expedia, Trivago, etc.), on the same date and under strictly identical stay conditions (same room, same duration, same options, same cancellation conditions, etc.) is lower. It will be the customer’s duty to provide proof of this lower price. If the rate applied on the hotel-carantec.fr site is equal or lower, the refund cannot take place.

III. RESERVATION CONDITIONS

A. General Conditions

  1. Your bank card number as well as its validity date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram will be requested when booking.
  2. As a deposit, 30% of the total amount of the stay indicated at the time of booking is debited from the bank card provided at the time of booking.
    A bank authorization request can be made on your bank card. The amount cannot be higher than the amount provided on your confirmation.
  3. The authorization request is not an immediate debit but corresponds to a reserve for subsequent payment, authorized by the customer’s bank, which temporarily reduces the limit of the bank card used to guarantee the possibility of subsequent debit. In some cases, however, the authorization request may appear as a pending debit on the bank account associated with the card used.

B. Special case of special offers

  1. Your bank card number as well as its validity date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram will be requested when booking.
  2. The total amount of the accommodation indicated at the time of booking is debited from the bank card provided at the time of booking. Tourist taxes are excluded.

C. Special case of packaged stays

  1. Your bank card number as well as its validity date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram will be requested when booking.

  2. The services ordered via a card will be those mentioned on the said gift voucher.
  3. Your bank card number as well as its validity date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram will be requested when booking.
  4. In the case of booking with a valuable gift voucher, and if the value of this gift voucher is not entirely used during the stay, the customer will not be able to claim a refund of the remainder. The remainder remains valid for a future service until the end of the validity of the gift voucher.

E. Special case of reservations with “Gift voucher”

  1. Holders of a gift voucher must provide the unique code appearing on their gift voucher at the time of booking.
  2. Your bank card number as well as its validity date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram will be requested when booking.
  3. If the value of the gift voucher is not entirely used during the stay, the customer will not be able to claim a refund of the remainder. The remainder remains valid for a future service until the end of the validity of the gift voucher.

F. Special case of “Evening Stopover” reservations

  1. With some exceptions, this formula is valid on Wednesday and Thursday. The Evening Stage rates are preferential rates intended for professionals on the move, so you may be asked for a professional business card.
  2. “Evening Stopovers” only apply to professional stays in single room occupancy.
  3. Your bank card number as well as its validity date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram will be requested when booking.
  4. A bank authorization request can be made on your bank card. The amount cannot be higher than the amount provided on your confirmation. The authorization request is not an immediate debit but corresponds to a reserve for subsequent payment, authorized by the customer’s bank, which temporarily reduces the limit of the bank card used to guarantee the possibility of subsequent debit. In some cases, however, the authorization request may appear as a pending debit on the bank account associated with the card used.

G. Special case of “Wonderbox” and “Smartbox” reservations

  1. Holders of a Wonderbox or Smartbox gift voucher must provide the unique code appearing on their voucher at the time of booking.
  2. The services ordered through the box will be those mentioned on the gift voucher.
  3. Reservations are subject to room availability at the time of request.
  4. No flexibility will be granted regarding the dates or services offered by the box.
  5. Wonderbox and Smartbox gift vouchers are non-cancelable, non-modifiable, and non-refundable. In the event of no-show, the services included in the gift voucher will be acquired by the hotel.
  6. In the event of early departure, the services included in the gift voucher will be considered as consumed, and no compensation or reimbursement will be granted.

IV. CANCELLATION AND MODIFICATION CONDITIONS

A. General Conditions

  1. For accommodation services (reservation of rooms within an establishment or other types of accommodation), the customer is reminded that he does not have the right of withdrawal provided for in article L. 221-18 of the Consumer Code, in accordance with article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to accommodation services which must be provided on a date or at a fixed period.
  2. In the event of a request to modify the dates of stay, the type or quality of the service, prices may be revised upwards. The deposit will be carried over to this new reservation. In the event of an increase in the initially planned price, an additional deposit will always be charged within the limit of 30% of the estimated total of the service. Any request for modification must be made in writing (e-mail or post). Any modification is deemed valid only after written agreement from the establishment.
  3. Regardless of the cancellation deadline, the deposit is not refundable.
  4. Any cancellation request must be made in writing (e-mail or post). The date of the request (date of sending the e-mail or postmark) will be taken into account when calculating the cancellation period.
  5. You can cancel your reservation up to 7 days before your arrival. After this period the first night will be billed and debited to your bank card. The deposit paid is not deducted from this amount.
  6. In the event of a no-show, the total amount of the accommodation will be charged to the card provided at the time of booking, less the deposit paid.
  7. In the event of interruption of the service due to the customer (early departure for example), the entire agreed price will be collected.
  8. Cancellation of the reservation for a service reserved online can be made directly on the site via the “Consult or cancel your reservation” section of the online reservation platform.
  9. Modification or cancellation of the reservation for a service can be made directly with the establishment, whose telephone and other contact details are specified on the reservation confirmation sent by email.

B. Special case of special offers

  1. For accommodation services (reservation of rooms within an establishment or other types of accommodation), the customer is reminded that he does not have the right of withdrawal provided for in article L. 221-18 of the Consumer Code, in accordance with article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to accommodation services which must be provided on a date or at a fixed period.
  2. Regardless of the cancellation deadline, the amounts paid are not refundable.
  3. In the event of interruption of the service due to the customer (early departure for example), in the case of reservations with pre-payment before the stay, no refund will be granted.

C. Special case of packaged stays

  1. For accommodation services (reservation of rooms within an establishment or other types of accommodation), the customer is reminded that he does not have the right of withdrawal provided for in article L. 221-18 of the Consumer Code, in accordance with article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to accommodation services which must be provided on a date or at a specific period.
  2. Regardless of the cancellation deadline, the deposit is not refundable.
  3. You can cancel your reservation up to 7 days before your arrival. After this period, the entire stay will be billed and debited to your bank card after deduction of the deposit paid.
  4. In the event of a no-show, the total amount of the stay will be charged to the card provided at the time of booking, less the deposit paid.
  5. In the event of interruption of the service due to the customer (early departure for example), the entire agreed price will be collected.

D. Special case of reservations with “gift voucher”.

  1. For accommodation services (reservation of rooms within an establishment or other types of accommodation), the customer is reminded that he does not have the right of withdrawal provided for in article L. 221-18 of the Consumer Code, in accordance with article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to accommodation services which must be provided on a date or at a fixed period.
  2. Cancellation more than 7 days before arrival and the validity date of the gift voucher is after the date of stay: no fees and the gift voucher lasts until its validity date.
    Cancellation more than 7 days before arrival but the validity date of the gift voucher is prior to the date of stay: the services included in the gift voucher are invoiced. The value and use of the gift voucher are lost.
    Cancellation less than 7 days before arrival: services included in the gift voucher are charged. The value and use of the gift voucher are lost.
  3. In the event of a no-show, the services included in the gift voucher are acquired by the hotel and any additional services or balance of the stay planned at the time of booking will be billed to the bank card provided at the time of booking.
  4. In the event of interruption of the service due to the customer (early departure for example), the services included in the gift voucher are acquired by the hotel and any additional services or balance of the stay billed to the bank card provided at the time of booking.
  5. For Catering services (reservation of a table at the restaurant or culinary workshop), the establishment reserves the right to keep all or part of the gift voucher as a penalty in the event of no-show or cancellation less than 48 hours before the reservation date.

E. Special case of reservations with “gift voucher”

  1. For accommodation services (reservation of rooms within an establishment or other types of accommodation), the customer is reminded that he does not have the right of withdrawal provided for in article L. 221-18 of the Consumer Code, in accordance with article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to accommodation services which must be provided on a date or at a fixed period.

  7. Cancellation of the reservation for a service reserved online can be made directly on the site via the “Consult or cancel your reservation” section of the online reservation platform.
  8. Modification or cancellation of the reservation for a service can be made directly with the establishment, whose telephone and other contact details are specified on the reservation confirmation sent by email.

G. The case of force majeure

  1. Force majeure means any event external to the parties which is both unpredictable and insurmountable and which prevents either the client or the hotelier from fulfilling all or part of the obligations provided for in the contract. This is particularly the case in the event of a strike, insurrection, riot, prohibitions decreed by government or public authorities.
  2. It is expressly agreed that force majeure suspends, for the parties, the execution of their reciprocal obligations and that each party bears the burden of the resulting costs. Customers will in particular bear only the additional costs which may be incurred to enable the continuation of the trip, following the occurrence of a case of force majeure.
  3. The deposit paid when booking the service will be retained and can be used as part of a new service within a maximum period of 18 months.
  4. In the event of force majeure or another exceptional event which prevents the Service from being carried out and in particular from making the room of the establishment reserved available to the Client, the establishment may reserve the possibility of having the Client accommodated, totally or partially, in an establishment of equivalent category or carrying out a service of the same nature, subject to the Client’s prior agreement.

H. Special case of “Wonderbox” and “Smartbox” reservations

  1. Holders of a Wonderbox or Smartbox gift voucher must provide the unique code appearing on their voucher at the time of booking.
  2. The services ordered through the box will be those mentioned on the gift voucher.

V. GIFT CARDS AND VOUCHERS

The offers are valid for a period indicated by the establishment at the time of purchase, the validity period begins from the date of purchase and not of reservation on the site.
The purchase of the offer is made by the customer. On the other hand, the latter is not necessarily the beneficiary.
A reservation, subsequent to the purchase, must be made to use the offer.
The reservation must be made during the validity period of the offer. The date of the reserved service cannot be outside this same period of validity.
The beneficiary, provided with the unique code relating to the offer purchased, must reserve their service by contacting the establishment. The establishment is, in no way, responsible for booking services.
The establishment reserves the right to set the dates of availability of services. These are available for consultation when booking.
In the event that this validity period is exceeded, the offer is not refundable and will be considered acquired by the establishment.
From 90 days before the expiration date, you can extend the validity of your gift voucher by 30 days for an additional fee. To do this, connect to the link on your gift voucher.

VI. CANCELLATION INSURANCE

The Hotel offers its customers the option to take out a “Cancellation Insurance” contract with its partner Gritchen Affinity – 27, rue Charles Durand – CS70139 – 18021 Bourges Cedex (the Insurer).

The Hotel here offers a connection between the Customer and the Insurer for subscriptions via the online reservation platform or at the time of reservation by email, postal mail or telephone. The subscription amount is collected by the Hotel at the time of booking and transferred to the Insurer.

Claims management is done between the Customer and the Insurer on the dedicated website https://www.declare.fr/

The insurance offered allows you to be reimbursed for the amount of your stay in the event of unforeseen events before your stay.

VII. RESTAURANT

  1. Reservations for the restaurant can be made by telephone, email or on the hotel-carantec.fr website via the online reservation module.
  2. Your bank card number as well as its validity date (it is specified that the bank card used must be valid at the time of the stay) and the visual cryptogram will be requested when booking.
  3. A bank authorization request can be made on your bank card. The fixed amount of this authorization request is €40.00 per place setting. The authorization request is not an immediate debit but corresponds to a reserve for subsequent payment, authorized by the customer’s bank, which temporarily reduces the limit of the bank card used to guarantee the possibility of subsequent debit. In some cases, however, the authorization request may appear as a pending debit on the bank account associated with the card used.
  4. The number of place settings must be specified no later than 24 hours before the arrival of participants.
  5. In the event of a reduction in the number of place settings 24 hours before the participants’ arrival, the establishment reserves the right to debit the bank imprint deposited via the online reservation module or the fixed amount of €40.00 per place setting canceled for lunch and €80.00 for dinner on the bank card provided as guarantee.
  6. In the event of no-show, the establishment reserves the right to debit the bank imprint deposited via the online reservation module or the fixed amount of €40.00 per place setting canceled for lunch and €80.00 for dinner on the bank card provided as guarantee.

VIII. ANIMALS

Small pets (less than 15kg) are tolerated in the hotel (with a supplement of €35.00 per night) provided that they are kept on a leash within the establishment and in the immediate surroundings. Access to eating places is prohibited.
The hotel reserves the right to refuse access to its premises to customers who do not respect this criterion and may apply the cancellation conditions relating to no-shows.

IX. STAY & ROOMS

  1. In accordance with the regulations in force in certain countries, the customer may be asked, upon arrival at the hotel, to complete a police form. To do this, the customer will be asked to present an identity document in order to check whether or not they must complete the police form.
  2. The customer accepts and undertakes to use the room in a good manner. Also any behavior contrary to good morals and public order will lead the hotelier to ask the customer to leave the establishment without any compensation and/or without any reimbursement if payment has already been made. If no payment has yet been made, the customer must pay the price of the nights consumed before leaving the establishment.
  3. Rooms are available from 4:00 p.m. on the day of arrival and must be vacated by 11:00 a.m. on the day of departure.
  4. The entire establishment is non-smoking. Customers are therefore asked to respect this rule, particularly in the rooms. In the event of non-compliance with this rule, a fixed amount of €300.00 will be debited from the bank card provided when booking.
  5. In the event of any damage to the furniture or theft, the establishment reserves the right to debit a fixed amount of €500.00 from the bank card provided at the time of booking.
  6. The hotel offers WIFI access allowing guests to connect to the internet. The customer undertakes that the computer resources made available to him by the hotel are not used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or neighboring rights, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in Books I and II of the Intellectual Property Code when this authorization is required. If the customer does not comply with the aforementioned obligations, he risks being accused of an offense of counterfeiting (article L.335-3 of the intellectual property code), punishable by a fine of 300,000 euros and three years of imprisonment. The customer is also required to comply with the security policy of the hotel’s internet service provider, including the rules for using the security means implemented with the aim of preventing the illicit use of IT resources and to refrain from any act detrimental to the effectiveness of these means.
  7. In the event of loss of the key or if it is not returned upon departure, the establishment reserves the right to debit the sum of €55.00 from the bank card provided during the reservation.

X. RESERVED ACCESS

Access to certain parts of the establishment may be regulated. Information is provided at reception.

XI. DISLOCATION

In the event of an exceptional event or the impossibility of making the reserved room available to the customer or in the event of force majeure, the establishment reserves the right to fully or partially accommodate the customer in a hotel of equivalent category, for services of the same nature and subject to the customer’s prior agreement. The possible additional cost of the room, transport between the two hotels and a telephone call remain the responsibility of the establishment.

XII. RETURNS OF FORGOTTEN PERSONAL EFFECTS

Personal effects will be sent via the services of our partner Lhost. If personal effects are forgotten, the customer will receive information by email regarding possible return details and will process the return with our partner Lhost.

XIII. COMPLAINTS

Complaints relating to non-performance or poor performance of hotel services must, to facilitate their processing, be brought to the attention of the company L’HOTEL DE CARANTEC SARL in writing within eight days after the date of departure from the hotel directly to the hotel or to the Customer Service contact details indicated below. After having contacted the service (after-sales, after travel, etc.) and in the absence of a satisfactory response or in the absence of a response within 60 days, the customer can contact the Tourism and Travel mediator free of charge, whose contact details and referral procedures are available on their website. www.mtv.travel
